Definitions of terms used in this Document

Uncle Onion’s Lawn Care, LLC is referred to as “we” and “us” throughout these Terms and Conditions.

The reader of these Terms and Conditions and our clients are referred to as “you” throughout these Terms and Conditions.

These Terms and Conditions and the Policies contained within may be referred to as “Policy” or “Document” throughout this Document.

A potential client is any person or entity inquiring about services from us.

A client is any person or entity that has accepted a quote and is scheduled to receive services from us, is actively receiving services from us, or has received services from us at any time in the past.

Uncle Onion loves potential clients and clients equally.

 

 

By accepting our quote, you are accepting these Terms and Conditions.

Summary of Terms and Conditions. Please read the entire document for more information that is not included in these bullets. 

  • Your property will be ready for us to provide our services on the date and time scheduled.

  • You consent to allow our equipment and employees, subcontractors, and other representatives onto your property to complete the services you hired us to perform.

  • You will provide a clear and safe path for our equipment and personnel to transition from our vehicle(s) to your property.

  • You will provide a clear and safe path on your property for our equipment and personnel to perform the service(s).

  • You will leave gates unlocked. If gates are locked, you will tell us the location of a key or give us a combination or code.

  • At least one gate will open wide enough for a person and our equipment to access all areas of your property that need service.   

  • You consent to allow us to safely and efficiently perform all tasks necessary to complete the service.

  • You will remove, or have removed, pet waste, litter and garbage, children’s toys, BBQ grills, fire pits that are not permanently installed, and any other items that are not permanently installed and that are located within the mowing and trimming area.

  • You will not approach the operator of any equipment that is in operation.

  • You understand it is in your best interest to remain indoors while any piece of lawn equipment is in operation on your property.

  • You will keep children and pets indoors while we are performing our services.

  • You agree to release Uncle Onion’s Lawn Service, LLC, its owner(s), members, employees, and other representatives from liability due to any accidental death or injury, including to people, pets, and other animals, and damage to property. Damage to property can include scalping of the lawn, damage to turf areas from mowing equipment, damage to toys and other items left in the yard, damage to swimming pool and equipment, damage to vehicles and structures located on or near the property, or any other personal effects belonging to you or others.

  • You agree to cancel or reschedule at least the day before your service is scheduled.

  • If you are on a weekly mowing schedule, you agree to allow us to mow your lawn every week, even if you feel it doesn’t need mowing. See Our Services in this Document for more information.

  • You authorize Uncle Onion's Lawn Service, LLC to automatically charge your method of payment on file when services are complete. 

 

 

Our services

We schedule services Monday through Saturday. We reserve Sunday as a catch up day due to weather delays. Due to scheduling constraints, we cannot guarantee your desired day will be available at the time of scheduling. You can read about the services we currently offer below. All of our services are provided with all electric lawn equipment. Electric lawn equipment pollutes less than gas-powered equipment, is quieter than gas-powered equipment, and is just as strong as comparable gas-powered equipment. The one drawback to electric equipment is the initial purchase price is about three times that of a comparable gas-powered piece of equipment. We try to keep our prices competitive, but our equipment costs are much higher than comparable lawn mowing companies that use gas equipment.

 

 

Weekly Service

One electric mowing service every week

 

For the best manicured look and to maintain optimal health of your lawn, we highly recommend weekly mowing service. Science has proven that mowing AT LEAST once a week is best for your lawn. Allowing the grass to grow too high and cutting too much off at a time leads to disease, thatch buildup, and makes the lawn less durable during periods of drought. Mowing weekly has been proven to make a lawn less dependable on water and fertilizer, as well. We are strongly considering dropping bi-weekly mowing because we believe in weekly mowing so much.

 

 

Bi-Weekly Service

One electric mowing service every other week

 

This service is only recommended if you have a lawn that consists of a slow growing or short variety of grass. Bi-weekly mowing could lead to a high grass surcharge, eliminating any cost savings to paying for weekly service. Be sure you understand our High Grass Surcharge Policy, located in this Document, before scheduling bi-weekly services. Bi-Weekly mowing services MAY have limited availability. We reserve the right to refuse bi-weekly mowing services if we feel your lawn will repeatedly incur a high grass surcharge. We highly recommend weekly mowing service to ensure the best look for your lawn and to keep your grass at its peak health.

 

 

Take a Vacation Package

Schedule electric mowing services when needed

 

This package gives you the freedom to schedule us at your convenience without adhering to a schedule. With this package, you have the ability to schedule one service, multiple services, or login and schedule us whenever you need us. There’s no need to call us when the lawn needs mowing, just schedule our services through the online portal. Be mindful of our high grass surcharge when using this service. The High Grass Surcharge Policy is located in this Document.

 

 

How to schedule our services

 

It only takes 3 steps to sign up for our services, and all 3 can be completed in minutes.

 

1. Uncle Onion’s True Price

The first step is to complete your Uncle Onion’s True Price. There are two ways to complete the form. You can call us at 540-448-8446, or complete the from online at www.UncleOnionsLawn.com/TruePrice. Uncle Onion’s True Price consists of two parts.

Part 1. Your contact information and the location of the property needing service. See our Privacy Policy for information on how we collect your information, what we do with your information, and how we keep your information safe. In short, your information is kept with us and not sold or given away.

 

Part 2. Three questions to help us give an accurate price. We need to know how high the grass is, ensure we have access with our equipment, and which service you are inquiring about.

 

Within 24 hours, but usually the same day, you’ll receive a quote via email. See How Uncle Onion’s True Price works in this Document for more information.

 

2. Accept the quote.

 

After accepting your quote, you’ll receive a couple more emails from us.

1. You’ll receive an email with an invitation to set up your online portal.

2. You’ll receive an email confirming your service with us and telling you which day of the week we have you scheduled.

 

3. Online portal

Set up your online portal with a username and password, then set up your desired payment method.

From your portal, you can see your schedule, see our schedule, contact us, schedule other services, and more!

The customer portal is operated by our third party CRM. We cannot guarantee availability of the portal or accuracy of any information within your portal. 

 

The day before your service

We’ll send you an email the day before your service to let you know we’re coming.

 

The day of your service

You’ll receive an email with a receipt that we have completed the service. Your account will automatically be charged for the service. The email receipt will contain the date, the service provided, the address service was provided at, the amount charged, and our contact information.

 

If you wish to dispute a charge or service, you can contact us through the link in the email or through your online portal. See our Dispute Policy, Rain Policy, and Canceling and Rescheduling Policy, all located in this Document, for more information.

Overgrown Lawn Policy & High Grass Surcharge Policy

​

Our weekly and bi-weekly clients are exempt from this policy after their first mowing and except in instances where the client cancels a normally scheduled service and reschedules for a date the grass has grown to levels considered overgrown (usually more than 6" tall).  

​

As a general rule, we do not provide cleanup services, including mowing overgrown lawns. We do not price overgrown lawns upfront, but rather charge $115 an hour and calculate the final price based on our actual time. Uncle Onion’s Lawn Service, LLC bases all of our pricing on exact measurements so we know we are giving you an accurate price without ever having to visit your lawn. It’s possible to estimate the time it will take to mow an overgrown lawn, but it’s impossible to know exactly how much time it will take to do the job right.

 

Unless other information is provided while completing your Uncle Onion’s True Price, our quotes are for cutting 1/3 of the blade off the grass. We have clearly defined parameters that will trigger a surcharge for overgrown grass. Our electric equipment is just as strong and capable as gas-powered equipment. We keep our blades fresh and sharp to provide the highest quality cut. Even with the power of our equipment and our rigorous maintenance schedule to ensure our equipment is in the best operating condition, all mowing equipment is going to struggle through certain types, and certain heights, of grass.

 

You will always be notified prior to us beginning services that you are being charged a high grass surcharge and you will be given an opportunity to cancel the service. See What happens if the client denies the high grass surcharge? located at the end of this section for more information on canceling due to high grass.

 

We will attempt to call you before we begin services. If you don’t answer, we’ll leave a voice mail, followed by a text message and/or email. We’ll explain on the phone and/or in an email the reason for the high grass surcharge and give you options for canceling the service. We don’t like to surprise anyone by charging you more for our services, so we recommend you complete the Uncle Onion’s True Price as accurately as possible, and have us mow your lawn at least once a week.

 

If you chose the Take A Vacation Package to schedule us as-needed, be mindful that we may not be available for last minute bookings. Schedule our services with plenty of time to avoid the high grass surcharge. See below for events that WILL and WILL NOT trigger a high grass surcharge.

 

How the high grass surcharge is calculated

The high grass surcharge is a fee of $125 per hour for any of our time beyond the time quoted in your Uncle Onion’s True Price. The fee begins when the quoted time has passed, and ends when we sign out of the job. We will not know the exact amount of the high grass surcharge until the service has been completed, but we will give you an estimate, written or verbal, before beginning the service.

 

Here is an example of how the high grass surcharge is calculated: If we quoted $45 for 30 minutes of service, but it takes us a total of 1 hour to get approval from the client and to mow the lawn due to high grass, the high grass surcharge will be calculated based on the additional 30 minutes.

 

30 minutes x $125/hr = $62.50 high grass surcharge

$45 (original quote) + $62.50 (high grass surcharge) = $107.50

 

 

Why we charge this surcharge

We are paid by our time. High grass takes additional time to mow, so we need to be reimbursed for the additional time spent making your yard beautiful. Additionally, cutting more than 1/3 of the grass blade is bad for the grass. The high grass surcharge is necessary for us to deviate away from our normal mowing plan of mowing once a week to keep your lawn looking and feeling its best. Finally, mowing high grass is hard on equipment and hard on employees. It requires substantially more effort for a person to mow high grass than it does to mow well-kept grass. The fee covers the additional wear and tear on our equipment and rewards the employee for their hard work (our employees get a portion of the high grass surcharge).

 

What triggers a high grass surcharge?

A high grass surcharge can be triggered by any one of the following 8 parameters:

  1. Needing to cut at least 1/2 the grass blade, or two inches or more, either by customer request or out of necessity to cut tall grass down to measure equal to or less than 4” in height after being cut.

  2. Needing to cut the grass twice to provide a uniform cut.

  3. Needing to “knock down” any portion of the area of the lawn by trimming it with the string trimmer (weed eater) prior to mowing IF this additional trimming adds to our scheduled time.

  4. Unable to use the self-propel feature on the push mower because of high grass.

  5. Having to mow at slower speeds that add to our time.

  6. Repetitively needing to mow over areas to ensure a uniform cut.

  7. Raking or bagging grass clippings. This service will also incur a disposal fee.

  8. Anytime we determine accomplishing a uniform, clean cut is taking substantially more time than if the grass was not overgrown.    

 

What will NOT trigger a high grass surcharge?

There are some instances where we will not charge you a high grass surcharge, even if any of the 8 parameters for a high grass surcharge have been met.

 

  1. Grass is high as a direct result of Uncle Onion’s Lawn Service, LLC. We aren’t perfect, but we’re close! There are many reasons we may miss a service. If any of those reasons are our fault or the fault of the weather, you will not be charged a high grass surcharge. See our Rain Policy and Cancelation and Rescheduling Policy for more information.

  2. If we take more than one week to schedule you for your first service, you will not be charged a high grass surcharge. Our least favorite thing to do to our clients is to let their lawn get high because our schedule was too crowded to get to you in a timely manner. We will always schedule you within one week of you accepting our quote.* If we can’t get to you within a week, we’re too busy and you deserve better service. Sometimes we make mistakes, though rarely. We are so confident in our ability to get to you within one week of accepting your service that we’ll mow your lawn for free if we have to reschedule you beyond one week from your initial schedule date. This only applies to new clients setting up service for the first time. Not valid for delays due to weather, client canceling or rescheduling, or other factors outside our control.   3. We are having a bad day and it takes us longer to mow your lawn than anticipated. In other words, if it’s us and not you, you won’t be charged the surcharge.

  4. Any of the circumstances listed in our Rain Policy.

 

*Exceptions apply when scheduling before mowing season. In this case, we’ll get to you the first week of the mowing season, which usually begins in April.

 

What happens if the client denies the high grass surcharge?

We reserve the right to charge the client the full price of the scheduled service, less the high grass fee, if the client cancels, for any reason, the day services are scheduled.

 

Notes from Uncle Onion about the high grass surcharge: We want to make our clients happy and make your lives easier. We use this policy sparingly. We need to make sure our technicians are paid fairly for their time. If you tell us the grass is high in your Uncle Onion’s True Price, the extra time to cut high grass will be included in your quote. We’ll give you two prices, the initial price for cutting the high grass the first time, then the scheduled price for cutting the grass at normal heights the rest of the year. We’ll try to avoid the high grass surcharge, but please make sure you understand our policy on high grass. If you have questions, please call, text, or email us. Thank you! -Uncle Onion

 

 

Rain Policy

There is never a need for you to cancel our services due to poor weather. As part of our promise to make the task of taking care of your lawn easier on you, we take care of all rescheduling and canceling services due to weather. Our electric lawn equipment can mow in any condition as gas-powered equipment, but mowing wet lawns makes a mess. We have a strict rain policy to prevent damage to your lawn. In the event we need to reschedule your service due to weather, you’ll receive an email the day of your regular service letting you know when we’ll return, usually within two days. For instances of heavy or prolonged rain, we may not be able to make it back within two days. See your service package below for more details on rain delays for each service we provide.

 

Weekly Lawn Service Weather Policy

You will be rescheduled within two days. If we are unable to provide your weekly services within 2 days of your service date due to weather, we’ll cancel your service for that week and see you on your next regularly scheduled date. You will not receive two cancelations in a row due to weather. If your next service is canceled due to weather, we’ll come back within five days to get your lawn back on schedule. You will not be charged for services that were not provided, unless stated otherwise in this Policy or elsewhere.

 

Bi-Weekly Lawn Service Weather Policy

You will be rescheduled within five to seven days, usually within two to three days. You will not be charged for services that were not provided, unless stated otherwise in this Policy or elsewhere.

 

Take a Vacation Package Weather Policy

You will be rescheduled within 2 days. If we are unable to reschedule you within 2 days due to heavy or prolonged weather, we will reschedule you again within 5 days of your first reschedule date, not to exceed one week (7 days) since your original service date. After 7 days, we will contact you via email or phone to give you the option to reschedule again or to cancel the service. You will not be charged for services that were not provided, unless stated otherwise in this Policy or elsewhere.

 

 

Cancelation and Rescheduling Policy

There is never a need for you to cancel our services due to poor weather. We’ll take care of that for you! See our Rain Policy for more information on weather related cancelations and rescheduling.

 

What if the grass doesn’t need to be mowed on my normal schedule date?

 

Just as there is never a need to cancel or reschedule due to weather, there is no need to cancel or reschedule due to grass not growing. Let us come see the yard and determine whether it needs mowing or not. Even in slow growing times of the year, it’s good practice to mow even when it appears there isn’t much being cut off. The less of the grass blade we can cut off at a time, the healthier your grass will be and the better it will look. Hang in there and allow us to keep mowing even when the grass doesn’t look like it needs it. Chances are, by the time we return the following week, it’ll be too high and you would have suffered through a few days of higher grass than you would like (and we might have to charge a high grass surcharge). We really aren’t trying to squeeze more money out of you! You will not be charged for services that were not provided, unless stated otherwise in this Policy or elsewhere.

 

 

If you need to cancel or reschedule for reasons other than weather or the grass not needing service during a particular week, please cancel prior to 5 pm the day before your service is scheduled. We reserve the right to charge the full service price for same day cancelations. You will receive an email the day before your service. Feel free to reply to that email to cancel or reschedule to avoid being charged for the service.

 

Notice: Excessive cancelations, or suspected abuse of our cancelation policy for any purpose, including skipping weekly mowing services, can lead to the full price of the canceled service being charged to your account and/or your account being terminated. You will be sent a written notice, via email, when we suspect you are abusing our Policy. A subsequent occurrence of suspected Policy violation after a notice of violation email has been sent to you may result in the suspension or termination of your account with us. We do not need to notify you to charge for services due to client cancelations that are covered elsewhere in this Document.

 

How do you know when we are coming?

You have the option to schedule us for Weekly, Bi-Weekly, or as-needed (Take a Vacation) services. With every service, you are able to see your schedule for the entire year in your client portal. If you chose a weekly or bi-weekly service, you will receive services the same day of the week, unless there is a weather delay. Additionally, all clients will receive a reminder email the day before services are scheduled. The reminder will include a link to this Document and a summary of our Cancelation and Rescheduling Policy, which is also included in this Document.

Yard Not Ready or is Inaccessible Policy

If we arrive to your address and the yard is not ready for service, other than for weather, lack of growth, or any other reason exempted expressly by this Document, or we cannot access the property or any portion of the property included in the service quote, we reserve the right to charge the full service price without providing services. We will attempt to call you, at which time you may request we wait while you make the property ready or accessible. We are under no obligation to wait for any amount of time or to reschedule service, although we’ll do our best with the time we have.

 

You are responsible for ensuring our equipment has clear and safe access to all areas of your property you want us to service. This includes providing a flat area for our equipment to transition from the street to your property, such as a clear driveway. We will not cross over curbs with our zero turn riding (ZTR) mower. If we can access your property with a push mower, we will provide the service, but mowing with the push mower when we quoted using the ZTR will require a price increase due to the extra time it will take to mow with the smaller push mower.

 

Reasons the yard may not be ready could include, but are in no way limited to:

  1. Access is blocked for our equipment to enter the yard or any portion of the yard, such as parked cars or a locked or inoperable gate. If we can’t get our equipment into your yard, we can’t mow. Our technicians are under no obligation to wait for access or to return later the same day, although they will attempt both if they have time.

  2. Access is blocked for our equipment to enter any portion of the yard that is included as part of our service.

  3. We are denied access for any reason. This can include not being granted access to a gated community.

  4. Damage to the yard, such as construction, digging, trenching, or any other situation that would could cause damage to our equipment.

  5. Any activity occurring on or near the property that poses potential harm to our staff or other people and equipment.

  6. Events occurring on premises that may or may not include people on the premises.

  7. Structures, permanent or temporary, that could be damaged by our services or are in the way of our services.

  8. People present in the mowing area, no matter how many or for what purpose.

  9. Structures, temporary or permanent, that are blocking or impeding our ability to provide our service(s).

  10. Excessive trash, litter, or garbage present upon our arrival.

  11. Excessive pet waste present upon our arrival.

  12. Any other circumstances that prevent us from performing our services or that provide a safety hazard.

  13. You fail to abide by our Terms and Conditions.

  

 

Payment Policy

Payment is due immediately when services are complete. We do not accept prepayment, nor do we accept payment in person. We will not invoice for work to be paid later.

Your method of payment is AUTOMATICALLY charged when services are complete. You will receive a receipt via email showing the charge, the service provided, the date, our contact information. Additionaly, you can see all charges in your client portal, as well as photos of the completed work.

Uncle Onion’s Lawn Service, LLC does not store your payment information, unless we explicitly tell you we are storing your payment information. Your payment information is managed by you through your client portal. The client portal is managed by our CRM provider, TurfHop (www.turfhop.com). Credit card payments are processed through Stripe (www.stripe.com). TurfHop and Stripe store your credit card information through an API. See our Privacy Policy for more information on how we keep your payment information secure.

 

We do not charge our clients any fees for using our acceptable forms of payment. This practice is subject to change without notice.

 

We do not offer a monthly payment plan or invoice to be paid at a later date. This helps us to keep our overhead costs down by removing the need to track credits due to weather and other unforeseen circumstances that require a scheduled service to not occur. To ease the burden of making payment on you and our lawn care technicians in the field, we do not accept payment in person.

 

If your payment method is declined, we will send you an invoice payable immediately. We will not resume services until the past due invoice is paid in full. We may send the non-payment to collections. 

 

By accepting our quote, you are agreeing to this statement:

I agree to keep my credit card information on file and current. I authorize Uncle Onion's Lawn Service, LLC to automatically charge my card on file when services are complete. I understand that my card will NOT be charged if services have not been rendered, unless otherwise stated in the terms & conditions.

   

Right to refuse service

We reserve the right to refuse service for any reason. We are under no obligation to provide a refund for services provided for any reason covered by this Document, for abuse of our Terms and Conditions and other Policies, or for endangering the well being of our staff, employees, subcontractors, or any of our representatives.

 

Uncle Onion’s Lawn Service, LLC is a safe space for all. We will not tolerate:

 

  • Racism

  • Sexism

  • Hate speech, including signs and symbols presented on client’s property

  • Some of our employees may be gay, lesbian, bisexual, or transgendered. Keep your negative comments about our employees and anyone else to yourself.

  • Bullying

  • Violence, even the appearance of violence

 

You are privileged to freedom of speech. It doesn’t mean we have to subject ourselves to it.


You have the right to refuse our service. You will receive a refund or no charge will be applied to your account when you follow our Cancelation and Rescheduling Policy.

 

Refund Policy

All services are final without any returns or refunds. Refunds will be considered if there is clear and obvious neglect from us or any of our representatives. See the Disputes section of this Document for more information on the dispute and complaint process. See the Satisfaction Guarantee section of this Document for more information on our commitment to your satisfaction.

 

We are under no obligation to provide a refund for services provided for any reason covered by this Document, for abuse of our Terms and Conditions and other Policies, or for endangering the well being of our staff, employees, subcontractors, or any of our representatives.

 

 

Non-contractural services

Our services are offered without a contract. By accepting our quote and scheduling services, whether weekly, bi-weekly, or our Take a Vacation Package, you are not entering into a contract with us. You may cancel services at any time without incurring any charges as long as our Cancelation and Rescheduling Policy is followed.

 

 

Warranty

Due to the nature of the services we offer, our work is not warranted. We do offer a 100% satisfaction guarantee. See Satisfaction Guarantee for more information.

 

 

Satisfaction Guarantee

If you are not 100% satisfied for ANY reason, bring it to our attention and we promise to make it right. This can include a refund, if warranted. 

 

We are so confident in our ability to get to you within one week of accepting your service that we’ll mow your lawn for free if we have to reschedule you beyond one week from your initial schedule date. This only applies to new clients setting up service for the first time during the mowing season (April - October). Not valid for delays due to weather, client canceling or rescheduling, or other factors outside our control.  See the Rain Policy and Cancelation and Rescheduling Policy for more details.

 

Your Uncle Onion’s True Price is guaranteed for the remainder of the mowing season. Our pricing is as much a science as it is an art. We are confident in our pricing model and will stand by it. The only time your price will change during the mowing season is if we over priced your lawn.    

A few things will void your Uncle Onion’s True Price guarantee.

  • Inaccurate information given or information withheld from your Uncle Onion’s True Price Form. This could include not telling us about high grass or not notifying us about a change to your property than what is visible on satellite imagery.

  • Requesting us to service a larger area than what was shown on your quote.

  • Giving us the wrong address on the Uncle Onion’s True Price Form so we quoted the wrong property.

Disputes

If you are not 100% satisfied for ANY reason, bring it to our attention and we promise to make it right. Customer service is our top priority.

 

Due to the nature of the services we provide, we request you bring any concerns or complaints to our attention immediately. Grass and plants grow every minute, so the longer you wait to bring a complaint about our services to our attention, the more difficult it will be to resolve.

 

We strive for excellence in the services we offer and in the way we relate to our clients. In our desire to provide you with honest services, you will receive photos of the work when it is completed. If you feel you have been charged for services that were not provided, or were provided inadequately, bring it to our attention immediately and we’ll resolve the issue for you.

 

If you want to dispute anything other than lawn service(s) provided, please bring it to our attention within 30 days. There is no statute of limitations for complaints, but problems are easier to solve when addressed within a few days after they occur, especially for disputes involving plants.

 

Uncle Onion’s Lawn Service, LLC is comprised of one person. Aaron Johnson does all the work without any other employees. If you have a complaint about Aaron, please bring it to his attention so he can have the opportunity to ensure your satisfaction.

  • You will have an online portal where you can manage your entire lawn care needs through us without ever having to pick up a phone. If you do call us, we’ll return your call within 24 hours, usually the same day. We are improving our phone policy so you’ll reach a person every time you call.

  • You will never have to be present for our services.

  • You will never have to remember to leave payment for us.

  • You will never have to keep up with credits for services not received since we don’t have a prepay plan.

  • We are always open to suggestions for ways to improve the conveniences we offer.
